The agency’s latest enforcement push targets alleged discriminatory practices involving support for political movements, including President Trump and the MAGA platform, pro-life advocacy, and lawful industries historically disfavored by the Left.

The CFPB’s announcement directly responds to a newly released report by the Office of the Comptroller of the Currency titled “Guaranteeing Fair Banking for All Americans.” The OCC report exposes widespread policies and practices among the nation’s largest financial institutions that restricted or denied financial services to Americans based on their political or religious beliefs, or because they operated within lawful, though politically controversial, business sectors.

According to the OCC investigation, the nine largest national banks under its direct supervision—JPMorgan Chase Bank, Bank of America, Citibank, Wells Fargo Bank, U.S. Bank, Capital One, PNC Bank, TD Bank, and BMO Bank—maintained internal frameworks that allowed for the restriction of banking services rooted in ideological profiling. The OCC report includes direct excerpts from internal bank documentation, such as corporate emails, which shed light on biased and discriminatory decision-making processes within these institutions. The findings indicate that entire commercial sectors were subjected to debanking, with firearms manufacturers, oil and gas enterprises, and tobacco companies bearing the brunt of the restrictive policies.

Acting CFPB Director Mark Paoletta strongly condemned the practices detailed in the regulatory findings, pointing to the ideological targeting of everyday consumers and lawful businesses.

“It is appalling that these banks targeted American consumers for their political, social, or religious beliefs that did not align with the Biden Administration or its leftist allies,” said CFPB Acting Director Mark Paoletta. “Many of those targeted were supporters of President Trump. These thuggish tactics, which were also a defining feature of the Biden-Chopra CFPB, have no place in America. We thank the Department of the Treasury and the Office of the Comptroller of the Currency for conducting its review to shed light on these shameful practices. The CFPB will fully investigate whether the institutions featured in OCC’s report and others have complied with federal consumer financial laws and take appropriate action.”

The CFPB holds primary supervisory and enforcement authority over major financial institutions with over $10 billion in assets, including the nine national banks named in the OCC report. The agency also oversees certain nonbank financial institutions to ensure rigorous compliance with federal consumer financial protection statutes.

This latest enforcement initiative forms a central pillar of the agency’s ongoing efforts to implement Executive Order 14331, titled “Guaranteeing Fair Access to Banking for All Americans.” The executive order aims to eliminate political and ideological bias from the financial sector and ensure that all legal businesses and citizens maintain unimpeded access to the banking system.

Under the framework of this initiative, the CFPB evaluates financial institutions for compliance with foundational civil rights and consumer protection laws. These include the Equal Credit Opportunity Act and the Fair Credit Reporting Act, with a particular focus on mandatory adverse action notice requirements. Additionally, the agency scrutinizes institutions under statutory prohibitions against Unfair, Deceptive, or Abusive Acts or Practices, commonly known as UDAAP, launching formal investigations whenever supervisory data or consumer complaints warrant further scrutiny.

In the lead-up to today’s announcement, the consumer bureau conducted a comprehensive internal review of its own Examination Manual, regulatory guidance, and administrative materials used to oversee financial institutions. This internal audit was designed to root out any legacy reputation risk concepts that could inadvertently facilitate or encourage unlawful debanking by regulated entities. Concurrently, the agency has systematically analyzed consumer complaints, supervisory findings, and enforcement records to identify empirical evidence of discriminatory account closures or service denials, laying the groundwork for independent agency investigations.

To further bolster its oversight and gather real-time intelligence from the public, the CFPB has recently updated its official website and consumer complaint portal. The updated digital resources are designed to raise public awareness regarding the mechanics of debanking and provide clear guidance for affected individuals and businesses. The bureau continues to urge consumers who believe they have been unlawfully denied financial access based on their political affiliations, religious beliefs, or lawful commercial activities to submit formal complaints through its portal to aid ongoing federal inquiries.

WASHINGTON — In a major escalation of federal oversight regarding corporate financial access, the Consumer Financial Protection Bureau announced today that it is taking the next step in its initiative to combat the debanking of businesses and individuals based on their constitutionally protected rights.
