This regulatory push focuses heavily on protecting citizens from being denied financial services on the basis of their constitutionally protected rights, which include support for President Trump, the MAGA movement, pro-life causes, and various industries that have historically fallen out of favor with the political Left. In response to a sweeping and comprehensive report on debanking practices released by the Office of the Comptroller of the Currency, the CFPB has committed to addressing any and all consumer harm caused by the nation’s largest financial institutions.

The Office of the Comptroller of the Currency report, titled “Guaranteeing Fair Banking for All Americans,” revealed troubling findings following a thorough examination of the nine largest national banks currently operating under its direct supervision. These institutions include JPMorgan Chase Bank, Bank of America, Citibank, Wells Fargo Bank, U.S. Bank, Capital One, PNC Bank, TD Bank, and BMO Bank. According to the regulatory review, these major banks maintained explicit policies or engaged in systematic practices that effectively denied or restricted financial access based on Americans’ political or religious beliefs, as well as a customer’s otherwise entirely lawful business activities.

To substantiate these findings, the OCC report provided direct excerpts from internal bank documents, including internal emails that revealed a pattern of biased and discriminatory decision-making behind closed doors. Furthermore, the report demonstrated that entire economic sectors were made victims of this debanking phenomenon. Most notably, businesses operating within industries related to firearms, oil and gas, and tobacco bore the brunt of these financial restrictions, cutting off legitimate companies from essential banking infrastructure simply due to the nature of their legal trade.

Acting Director of the CFPB Mark Paoletta did not mince words when addressing the findings of the regulatory report. In a statement released alongside the bureau’s announcement, Paoletta expressed profound concern over the targeted exclusion of ordinary citizens and corporate entities.

“It is appalling that these banks targeted American consumers for their political, social, or religious beliefs that did not align with the Biden Administration or its leftist allies,” said CFPB Acting Director Mark Paoletta. “Many of those targeted were supporters of President Trump. These thuggish tactics, which were also a defining feature of the Biden-Chopra CFPB, have no place in America. We thank the Department of the Treasury and the Office of the Comptroller of the Currency for conducting its review to shed light on these shameful practices. The CFPB will fully investigate whether the institutions featured in OCC’s report and others have complied with federal consumer financial laws and take appropriate action.”

As part of its jurisdictional mandate, the CFPB holds primary supervisory and enforcement authority over banks with more than $10 billion in assets—a threshold that includes all nine of the major institutions cited in the OCC report. Additionally, the bureau retains oversight over certain nonbank financial institutions to assess whether they maintain full compliance with federal consumer financial laws.

The latest announcement from the CFPB forms a core component of the agency’s broader undertaking to fully implement Executive Order 14331, titled “Guaranteeing Fair Access to Banking for All Americans.” This executive directive serves as the foundational framework for the agency’s overarching priority to vigorously remedy the issue of unlawful debanking across the United States banking sector.

Under the umbrella of this directive, the CFPB routinely evaluates financial institutions for compliance with foundational statutes such as the Equal Credit Opportunity Act and the Fair Credit Reporting Act. Particular scrutiny is being applied to the adverse action notice requirements mandated under these laws, alongside investigations into Unfair, Deceptive, or Abusive Acts or Practices. When the data warrants such a step, the bureau opens formal investigations into offending institutions.

Prior to today’s announcement, the CFPB undertook a comprehensive review of its own Examination Manual, regulatory guidance, and other internal materials utilized to regulate and examine financial institutions operating under its authority. The goal of this internal audit was to ensure that these documents do not contain vague reputation risk concepts that could inadvertently or intentionally result in unlawful debanking by supervised entities. Furthermore, the agency has dedicated substantial resources to reviewing consumer complaints, along with supervisory and enforcement data, specifically searching for evidence of potential unlawful debanking. Based on these data streams, the bureau has been actively pursuing its own independent investigations.

In tandem with these enforcement and investigative measures, the CFPB has also taken steps to empower everyday consumers. The agency recently updated its official website and its consumer complaint portal with specialized information designed to raise public awareness about the realities of debanking. Through these channels, the bureau continues to actively encourage consumers to submit formal complaints if they suspect or believe they have been unjustly debanked by their financial institutions.

Today, the Consumer Financial Protection Bureau announced the next major step in its ongoing work to advance the administration’s initiative against the debanking of businesses and individuals.
